Bangladeshi Petrol Station Worker Fined RM10,000 For Using MyKads To Purchase BUDI95

KUALA LUMPUR, May 5 (Bernama) -- The Magistrate's Court here today imposed a RM10,000 fine on a Bangladeshi petrol station worker for possessing and using two MyKads to purchase BUDI MADANI RON95 (BUDI95) petrol last month.

Magistrate Aina Azahra Arifin imposed the sentence on Md Jakir Hossain, 50, after he pleaded guilty to two charges of using the identity cards belonging to two Malaysians, without authority and lawful reason, for the purpose. 

The court imposed a fine of RM5,000 or seven months' imprisonment in default of payment of the fine for each charge. The accused paid the fine.

The offences were committed at a petrol station on Jalan Pahang, here, between Feb 8 and April 22 last year, under Regulation 25(1)(o) of the National Registration Regulations 1990, which carries a maximum fine of RM20,000 or a maximum imprisonment term of three years, or both.

Deputy public prosecutor Hench Goh urged the court to impose a commensurate sentence, taking into account the loss of subsidised petrol quota suffered by the victims. 

"The accused had the option to return the identity cards, but instead proceeded to purchase the subsidised petrol," she said.

The accused’s lawyer, Low Carmen, applied for a light fine on the grounds that her client is the primary breadwinner of his family and has expressed regret for his actions.

According to the facts of the case, the complainant, who is the owner of the MyKad and works as an accountant, discovered that his BUDI95 subsidised petrol balance had decreased from 94.937 litres to 44.637 litres on April 22 last year.

He suspected that his identity card, which had gone missing the previous day, had been misused to fill subsidised fuel at a petrol station on Jalan Pahang.

A check with the Budi Madani service centre detected five suspicious transactions on the card.

Following a review of CCTV footage, the accused was arrested, and a search of his rental room uncovered two identity cards belonging to the complainant and another individual.
