PUTRAJAYA, Nov 13 (Bernama) -- A former company director, Tajul Arus Abdul Aziz, was acquitted and discharged by the High Court in Shah Alam today on four drug possession charges.
Judicial Commissioner Roszianayati Ahmad ruled that the prosecution failed to prove its case beyond reasonable doubt on all charges against Tajul, who had been accused of possession of the drugs.
Tajul’s lawyer Kee Wei Lon confirmed the High Court’s decision to Bernama.
According to Kee, Roszianayati found Tajul had not received a fair trial as the prosecution was unable to present several witnesses to the defence, including Tajul’s wife and mother-in-law, preventing him from presenting a full defence.
Tajul, 58, had been initially charged with one count of trafficking 35 grammes of heroin and 246 grammes of monoacetylmorphines, as well as three separate charges of possessing 9.14 grammes of methamphetamine, 0.38 grammes of heroin and 0.39 grammes of monoacetylmorphines.
The offences were said to have been committed at a house in Taman Tun Abdul Razak, Ampang, Selangor at 9.25 pm on June 22, 2020.
On July 12, this year, the High Court reduced the trafficking charge to possession and ordered Tajul to enter his defence on all the charges.
Kee said the prosecution had called eight witnesses during its case, while two witnesses including Tajul himself, provided testimony during the defence stage.
According to the facts of the case, a team of officers from the Narcotics Crime Investigation Division raided the house. A search was conducted on his (Tajul’s) body and a set of keys to a Toyota Alphard was found. The drugs were later discovered in the vehicle, which was parked in front of the house at the time.
Deputy Public Prosecutor Rosnee Mohd Radzuan represented the prosecution in the proceedings.
