SPARE PARTS COMPANY, DIRECTORS CHARGED WITH TRADEMARK INFRINGEMENT

KUALA LUMPUR, April 14 (Bernama) -- A vehicle spare parts company and its two directors were charged in the Selayang Sessions Court today with 15 counts of trademark infringement involving 7,473 units of lubricants and oil filters last year.

Well Perfect Auto Parts Sdn Bhd, represented by its directors Khoo Zhi Sheng, 42, and Yap Kok Lim, 43, pleaded not guilty to all charges before Judge Norazlin Othman.

The company faces five charges of possessing for trade 3,075 units of lubricant bearing the trademarks of two well-known car brands and 4,398 oil filters bearing the trademarks of three local and luxury car brands, with improperly registered trademarks under Section 100 of the Trademarks Act 2019.

The alleged offences took place at the company’s premises in the Kepong Industrial Park at 2:30 a.m. on April 30, 2025.

The charges were brought under Section 102(1)(c) of the same Act, which provides for a maximum fine of RM15,000 per item, and RM30,000 per item for a second or subsequent offence.

Khoo and Yap, as company directors, were each separately charged with five similar counts at the same place, time, and date under Section 102(1)(c)(ii), which carries a maximum fine of RM10,000 per item or three years’ jail, or both.

A subsequent offence carries a fine of up to RM20,000 per item, or up to 5 years’ jail, or both upon conviction.

Domestic Trade and Cost of Living Ministry (KPDN) prosecutor Azmil Aspara offered bail of RM10,000 per charge with one surety, plus monthly reporting to the ministry’s Putrajaya office.

The accused’s lawyer, Wayne Ng Wei Wei, sought reduced bail, citing his clients’ cooperation and noting they had previously been charged under the same Act at the Petaling Jaya Sessions Court.

The judge allowed bail of RM15,000 per accused with one surety, and the prosecution’s additional conditions, and set May 18 for the next case mention.

On April 1 last year, M Perfect Lubricant Sdn Bhd and its two directors pleaded not guilty in Petaling Jaya to possessing 229 counterfeit units of a famous engine oil brand.

On April 29 last year, three premises in Ara Damansara and Kepong were raided for rebottling engine oil using fake trademarks and false addresses.
