KLANG, Nov 5 (Bernama) -- A burger seller was jailed for six months and fined RM1,000 by the Magistrate's Court here today after pleading guilty to three charges of voluntarily causing hurt, committing mischief, and criminal intimidation on his ex-girlfriend in August.
Magistrate Siti Zubaidah Mahat ordered Akmalrulnizar Hafif Kamarulhisham, 23, to serve his sentence from the date he was arrested on Aug 11. He was also ordered to serve a four-month prison sentence if he failed to pay the fine.
On the first count, he was charged with voluntarily causing hurt to Nur Hiedayu Mudzakir, 23, with a baseball bat, an act which could have caused her death.
Upon conviction, the charge under Section 324 of the Penal Code carries a maximum 10-year jail term, a fine whipping, or both.
On the second count, he was charged with committing mischief by smashing his ex-girlfriend's car's front windscreen.
The offence under Section 427 of the Penal Code provides a maximum of two years jail term, a fine or both upon conviction.
On the third count, he was charged with criminally intimidating the victim by brandishing a machete at her.
The charge under Section 506 of the Penal Code carries a two-year jail term or both.
All the offences were committed at 6 am in Kampung Teluk Gong on Aug 10.
National Legal Aid Foundation (YBGK) lawyer Muhamad Saifullah Muhamad Azmi, representing the accused, explained that there was a misunderstanding between Akmalrulnizar and the victim and he had accidentally lost grip of the baseball bat, which struck her.
"My client has apologised and promised not to repeat it in the future. He seeks a short prison term to run concurrently," he said.
However, Deputy Public Prosecutor Nuruljannah Aimi argued that the accused faces three charges and urged the court to impose a deterrent sentence, taking into account the public interest factor.
"The accused has three charges of which is breaking the windshield of the car causing a loss of RM500. He also used a baseball bat and injured the knee of the complainant (victim) and had also brandished a machete (at the victim). I request a severe punishment for the accused," she said.
