MACC Investigations based On Evidence, Not Directives - MCW

KUALA LUMPUR, Sept 10 (Bernama) -- The Malaysian Corruption Watch (MCW) has strongly rejected attempts to politicise investigations by the Malaysian Anti-Corruption Commission (MACC), stressing that prosecution decisions are based on evidence, not political directives or social media perceptions.

MCW president Jais Abdul Karim said the non-governmental organisation takes seriously media reports that suggest the MACC and its Chief Commissioner, Tan Sri Azam Baki, acted under political instructions in a case involving a company linked to Datuk Seri Farhash Wafa Salvador.

He said the MACC conducts its investigations within the framework of existing laws, particularly the MACC Act 2009 and the Penal Code, before handing over all documents, witnesses, and financial transactions to the Attorney-General’s Chambers (AGC).

“It is the sole prerogative of the AGC to decide whether there are sufficient grounds for prosecution,” he said in a statement today.

Yesterday, the MACC confirmed that no mineral exploration activities were being carried out in Sabah by the company linked to Farhash, contrary to earlier claims.

At a press conference, Azam said investigations found the company had never applied for land from the Sabah government but had only submitted an application for mineral exploration to Sabah Mineral Management Sdn Bhd (SMM).

Jais said allegations that the probe was ‘directed’ or ‘protected’ by political leaders were baseless and malicious, pointing out that prosecution decisions are made by independent deputy public prosecutors, not the MACC Chief Commissioner.

He added that the pace of an investigation should not be spun to cast suspicion, as cases vary in complexity.

“Some cases conclude quickly due to clear and straightforward evidence, while others take longer because they involve complex networks of transactions,” he said.

Jais also reminded that the closure of an investigation does not mean a person is permanently cleared, as cases can be reopened at any time if new evidence emerges.

“Attacking the integrity of the MACC simply because outcomes do not align with certain political perceptions undermines nationwide efforts to combat corruption. The public deserves transparency, but transparency must be guided by law, not misleading political narratives.

“MCW calls on all parties to stop speculating and allow enforcement institutions and the AGC to carry out their roles independently,” he said.
