DKU Secretary To File Contempt Proceedings Over Alleged Injunction Breach

SEREMBAN, June 5 (Bernama) -- Negeri Sembilan Dewan Keadilan dan Undang (DKU) secretary Raja Norazli Raja Nordin said he will initiate contempt of court proceedings against those involved in the appointment of the Yang Dipertuan Besar, following what he described as a breach of an interim injunction granted by the High Court here today.

He said High Court judge Roz Mawar Rozain had granted the interim injunction in an originating summons to preserve the status quo of the DKU and his position as its secretary pending the hearing of jurisdictional and justiciability issues, and until further order of the court.

According to Raja Norazli, media reports indicated that the plaintiffs, particularly the second plaintiff, Undang Luak Jelebu Datuk Maarof Mat Rashad, were involved in and/or participated in the purported appointment of a Yang Dipertuan Besar under Article 11 of the Constitution of Negeri Sembilan 1959.

He said the reported appointment took place after the High Court issued the interim injunction earlier in the day. 

Raja Norazli said he viewed the actions of the plaintiffs, particularly Maarof, as a hasty attempt to disregard the court order.

“Accordingly, my solicitors have written to the plaintiffs' solicitors, and I have reserved my right to commence contempt proceedings against the plaintiffs in order to preserve the integrity of the court order,” he said in a statement tonight.

He added that the move would be in addition to contempt proceedings already filed against the plaintiffs over actions allegedly taken from the first hearing of the matter at the High Court on May 13 until today.

The contempt proceedings have been fixed for hearing on July 7.

Earlier today, the High Court allowed an application for an interim injunction against six plaintiffs in a dispute involving the Negeri Sembilan DKU, including restraining them from convening or holding any meeting, including a Special Sitting scheduled for today.

The six plaintiffs are former Undang Luak Sungai Ujong Datuk Mubarak Thahak, Undang Luak Jelebu Datuk Maarof Mat Rashad, Undang Luak Johol Datuk Muhammed Abdullah, Undang Luak Rembau Datuk Abdul Rahim Yasin, Tunku Besar Tampin Tunku Syed Razman Tunku Syed Idrus Al-Qadri, and Shahbandar Sungai Ujong Datuk Seri Badarudin Abdul Khalid.
