AGC Will Continue Defending Judiciary Against Unwarranted Attacks - Mohd Dusuki

PUTRAJAYA, Aug 6 (Bernama) -- The Attorney General Chambers (AGC) will continue defending the judiciary against unwarranted attacks in ensuring the integrity of the judicial processes, said Attorney General, Tan Sri Mohd Dusuki Mokhtar.

In this regard, he said the AGC has actively participated in judicial reforms aimed at enhancing judicial independence and improving efficiency, both crucial for sustaining public trust in the judiciary.

“The relationship between the judiciary and the AGC is one of mutual respect and shared responsibility. While we serve in different capacities within the legal system, we are united by a common purpose that is to uphold the law and serve the nation.

“The AGC plays an integral part in the administration of justice, we are the officers of the court, not to secure convictions but to ensure that the rule of law is upheld, thereby contributing to the smooth functioning of the criminal justice system,” he said in his speech at the special ceremony in honour of the recently appointed 17th Chief Justice of Malaysia Datuk Wan Ahmad Farid Wan Salleh at the Palace of Justice today.

He said the judiciary today does not operate in isolation, but within a dynamic legal environment influenced by global trends, technological advancements, and increasing public expectations.

“In this context, the judiciary must preserve the enduring principles of legal tradition while embracing innovation and reform where necessary,” he said.

Mohd Dusuki also pointed out that the judiciary plays a crucial role in ensuring that the executive and legislative branches operate within their constitutional limits, thereby maintaining a system of checks and balances.

“This role is integral to the doctrine of separation of powers, which serves to prevent the concentration of authority within a single branch of government.

“The decision by Your Lordship (Wan Ahmad Farid) to recuse yourself from hearing Datuk Seri Najib Razak’s application to allow a Queen's Counsel to represent the former prime minister in his appeal against his conviction in the SRC International Sdn Bhd case marks a significant moment in affirming the independence of the judiciary in our country,” he said.

Mohd Dusuki also reiterated that AGC is fully committed to preserving, protecting, and defending the country’s legal system and looking forward to working closely with the judiciary under the leadership of Wan Ahmad Farid to ensure that justice is administered in a manner that is both accessible and equitable.

“We are committed to collaborating constructively to improve judicial procedures and foster a litigation environment where expediency never compromises integrity, and accountability is embedded in every decision. 

“The entire force of the legal service stands to support Your Lordship in administering the law with integrity and compassion,” Mohd Dusuki added.

Meanwhile, the Malaysian Bar president Datuk Mohamad Ezri Abdul Wahab, in his speech at the event, said the Chief Justice plays a vital role not only in managing the judiciary’s administration but also in setting the tone, direction, and culture of integrity within the institution.

“In an era where various political, economic, and social pressures challenge the foundations of democracy and the rule of law, courageous and principled leadership is key to sustaining a respected judicial system.

“However, we firmly believe that with the wisdom, firmness, and integrity possessed by the Right Honourable Chief Justice, the country’s judiciary will continue to stand tall and unwavering, neither shaken by the winds nor swept away by the waves, as a beacon of justice and guardian of the rule of law,” he said.

Mohamad Ezri also noted the judiciary’s role as the custodian of the Federal Constitution and protector of every citizen’s fundamental rights.
