PHONE SHOP ASSISTANT CLAIMS TRIAL TO CAUSING DEATH OF DISABLED MAN

BATU PAHAT, May 2 (Bernama) -- A phone shop assistant pleaded not guilty in the Batu Pahat Magistrate's Court today to causing the death of a disabled man by reckless driving in February.

The accused, Lim Guan Yan, 24, made the plea after the charge was read before Magistrate Suhaila Shafi’uddin.

The accused allegedly committed the offence around 7 am on Feb 27 at Batu 21, Jalan Muar-Parit Sulong, resulting in the death of Mohd Riduan Abdullah, 58.

He is charged under Section 41(1) of the Road Transport Act 1987 (Act 133), which is punishable by an imprisonment of between five and ten years, and a fine of between RM20,000 and RM50,000, upon conviction.

Deputy public prosecutor Siti Khalijah Khalid appeared for the prosecution, while the accused was represented by National Legal Aid Foundation lawyer, Tan Song Yan.

The court allowed the accused, who resides in Muar, to be released on RM3,000 bail with one surety and ordered him to report to the Muar Police Station every month until the conclusion of the trial.

The court also set June 20 for the next case mention. 

On Feb 27, Mohd Riduan tragically lost his life when he was thrown from his motorcycle following a collision with a Toyota Vios driven by Lim, who was attempting to overtake another vehicle.

Mohd Riduan died on the spot due to severe head and body injuries, while Lim suffered only  minor injuries.
