WASHINGTON, July 15 (Bernama-Sputnik) -- US District Judge Aileen Cannon dismissed a superseding indictment against former US president Donald Trump in the classified documents case against him, an order filed on Monday said, reported Sputnik.
"Former President Trump’s Motion to Dismiss Indictment Based on the Unlawful Appointment and Funding of Special Counsel Jack Smith is granted in accordance with this Order. The Superseding Indictment is dismissed because Special Counsel Smith’s appointment violates the Appointments Clause of the United States Constitution," the order said.
Smith’s use of a permanent indefinite appropriation also violates the US Constitution’s Appropriations Clause, the order said.
Smith initially charged Trump with 37 counts related to his alleged mishandling of classified materials, and later filed a superseding indictment adding three more counts.
