Four Laws Under KESUMA To Take Effect On Sept 15

PUTRAJAYA, Sept 14 (Bernama) -- Four laws under the Human Resources Ministry (KESUMA) will come into force on Sept 15, aiming to enhance the principles of freedom of association and collective bargaining.

In a statement today, the ministry said that the four laws were the Industrial Relations (Amendment) Act 2020, the Trade Unions (Amendment) Act 2024, the Industrial Relations Regulations 2024, and the Trade Union Regulations 2024.

“The Industrial Relations (Amendment) Act 2020 was passed by Parliament and gazetted on Feb 20, 2020, while the Trade Unions (Amendment) Act 2024 was approved and gazetted on Jan 12, 2024,” it said.

According to KESUMA, the amendments to the main legislation within the industrial relations system are aimed at fulfilling Malaysia’s obligations under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP), particularly the Labour Chapter, which requires member countries to adopt and maintain laws and practices in line with the International Labour Organisation (ILO) Declaration of Fundamental Principles and Rights at Work (1998).

The amendments are also expected to raise national labour standards, taking into account fundamental international labour principles such as freedom of association and collective bargaining.

One of the key aspects of the amendments is the strengthening of the freedom of association, with previously imposed restrictions now abolished.

In addition, the amendments introduced diversity in trade unions representing workers within the same scope, as well as a new right to sole consultation.

“This move ensures Malaysian labour laws are in line with international standards, particularly the 1998 ILO Declaration, thereby enhancing the country’s image and attracting foreign investors.

“KESUMA believes the amendments will greatly benefit workers’ welfare and rights in Malaysia, particularly in terms of freedom of association and collective bargaining, while also boosting the country’s reputation at the international level,” it said.
