US To Impose 10 Pct Global Tariff Under Section 122 Following Supreme Court Decision

KUALA LUMPUR, Feb 21 (Bernama) -- President Donald Trump said the United States will impose a 10 per cent global tariff under Section 122, over and above the normal tariffs already in place.

Trump said he would sign the order and initiate several Section 301 and other investigations to protect the country from unfair trading practices.

“Therefore, effective immediately, all national security tariffs, Section 232 and existing Section 301 tariffs remain in place and in full force and effect,” he said on his Truth Social account on Friday after the US Supreme Court’s decision the same day striking down the reciprocal tariff imposed by the president.

On fentanyl, he said the tariffs had reduced fentanyl entering the US by 30 per cent.

“All of those tariffs remain, but other alternatives will now be used to replace the ones that the court incorrectly rejected,” Trump said.

Earlier, Kyodo reported that the US Supreme Court said the president’s use of emergency powers to hit nearly all of America’s trading partners with so-called reciprocal tariffs was unconstitutional.

Upholding the lower court’s findings, the highest court also ruled that Trump overstepped his presidential powers when he used the 1977 International Emergency Economic Powers Act to impose sweeping global tariffs, as well as fentanyl-related duties on goods from China, Canada and Mexico.

The decision was delivered in a 170-page ruling.

Following the latest court decision, many countries, including Malaysia, may need to revisit the deal signed earlier.

Malaysia and the US signed the Agreement on Reciprocal Trade (ART) on Oct 26, 2025.
